BY USING FSOCOMPASS.COM AND ITS SERVICES, YOU ARE CONSENTING TO THESE TERMS AND CONDITIONS. PLEASE READ THEM CAREFULLY.

1. Definitions

In these Terms and Conditions:

• “Path to Foreign Service, LLC,” “Company,” “we,” “us,” and “our” refer to Path to Foreign Service, LLC, the provider of the Service.
• “FSO Compass” refers to the online educational platform and service provided by Path to Foreign Service, LLC.
• “Service” means the online educational platform, including courses, forums, resources, and other content relating to the Foreign Service application process provided by Path to Foreign Service, LLC through fsocompass.com.
• “Site” refers to fsocompass.com and any associated web pages or mobile applications.
• “User,” “you,” and “your” refer to any individual or entity accessing or using the Site or Service.
• “Content” means all information, text, graphics, images, video, audio, data, or other materials uploaded, downloaded, or appearing on the Site.
• “User-Generated Content” means any content posted by users in forums or other interactive areas of the Service.
• “Completion Recognition” refers to any certificates or acknowledgments provided upon course completion.

2. Service Description

2.1 Path to Foreign Service, LLC provides FSO Compass, a membership-based online educational service including courses, forums, recordings, and other content relating to the Foreign Service application process.

2.2 The scope of services provided through FSO Compass is limited to those listed on the Site. Path to Foreign Service, LLC reserves the right to substitute services equal to or comparable to the services listed if the need arises, without prior notice.

2.3 You understand and agree that the Service is in the nature of education and preparation for the Foreign Service application process. Path to Foreign Service, LLC does not guarantee any specific outcomes or results from using the Service.

3. Subscription, Cancellation, and Refunds

3.1 Subscription Types:

1. Monthly Subscription: Provides access to the Service for 30 days from the date of purchase.
2. Annual Subscription: Provides access to the Service for 365 days from the date of purchase.
3. Lifetime Access: Provides access to the Service for as long as Path to Foreign Service, LLC continues to offer the Service. Lifetime Access will terminate if Path to Foreign Service, LLC ceases operations.

3.2 Automatic Renewal:

1. Monthly and Annual Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
2. By purchasing a subscription, you authorize Path to Foreign Service, LLC to charge your payment method on a recurring basis for the subscription fee plus any applicable taxes.
3. You acknowledge that your subscription will automatically renew unless you cancel it, and you authorize us to collect the then-applicable subscription fee and any taxes, using any payment method we have on record for you.

3.3 Cancellation:

1. You may cancel your subscription at any time through your account page or by contacting customer support at [email protected].
2. For Monthly Subscriptions, cancellation will take effect at the end of the current billing period. You will retain access to the Service until the end of your current paid-up month.
3. For Annual Subscriptions, cancellation will take effect at the end of the current annual period. No partial refunds will be issued for early cancellation of Annual Subscriptions.
4. Lifetime Access is non-refundable and cannot be cancelled once purchased.
5. It is your responsibility to cancel your subscription in a timely manner. Failure to cancel at least 24 hours before the renewal date will result in charges for the next subscription period.

3.4 Refunds and Disputes:

1. Refund requests will be considered on a case-by-case basis. Path to Foreign Service, LLC reserves the right to issue or deny refunds at its sole discretion.
2. No refunds will be provided for partial use of the Service or for periods where you did not log in to your account.
3. If you believe you’ve been charged in error, you must contact us within seven days of the charge date to request a refund. Requests made after this period will not be considered.
4. By agreeing to these Terms, you acknowledge that forgetting to cancel your subscription or non-use of the Service does not qualify for a refund or release you from your payment obligations.
5. In the event of a chargeback or payment dispute initiated by you, you agree to cooperate with Path to Foreign Service, LLC in resolving the dispute and provide any necessary documentation to your payment provider to validate the charge.

3.5 Dispute Resolution for Contested Charges:

1. If you contest a charge for your subscription, you agree to first contact Path to Foreign Service, LLC at [email protected] before initiating a chargeback or dispute with your payment provider.
2. You acknowledge that contesting a valid charge may result in the temporary or permanent suspension of your account and access to the Service.
3. In the event of a disputed charge, you authorize Path to Foreign Service, LLC to provide to the relevant payment provider or financial institution information about your subscription, including these Terms, to demonstrate your agreement to the contested charges.
4. You agree that Path to Foreign Service, LLC has the right to recover any chargeback fees or penalties imposed due to a chargeback or dispute that is resolved in Path to Foreign Service, LLC’s favor.

3.6 Record Keeping:

1. Path to Foreign Service, LLC maintains records of all transactions, subscription start and end dates, login activity, and communications regarding subscriptions and cancellations.
2. You acknowledge that these records may be used as evidence in the event of a dispute.

By continuing to use the Service, you acknowledge that you have read, understood, and agree to these subscription, cancellation, and refund policies.

4. Use of the Service

4.1 Eligibility: To access or use the Service, you must be 18 years of age or older and have the requisite power and authority to enter into these Terms and Conditions.

4.2 Lawful Use: You may use the Service for lawful purposes only. You agree to use the Service for legitimate, non-commercial purposes only.

4.3 Prohibited Actions: You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any law.

4.4 Content Disclaimer: Path to Foreign Service, LLC makes no representation or warranty that the information provided, regardless of its source, is accurate, complete, reliable, current, or error-free. Path to Foreign Service, LLC disclaims all liability for any inaccuracy, error, or incompleteness in the Content.

4.5 Technical Requirements: You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Service and that it is compatible with the Service. Path to Foreign Service, LLC does not guarantee that the Service will function on all devices.

5. Account Creation and Security

5.1 To use the Service, you will be required to provide information about yourself including your name, email address, username and password, and other personal information.

5.2 You agree that any registration information you give to Path to Foreign Service, LLC will always be accurate, correct, and up to date.

5.3 You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose.

5.4 You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

6. Member Conduct and Forum Usage

6.1 Acceptable Behavior: Members are expected to conduct themselves in a respectful and professional manner when participating in forums, comment sections, and other interactive areas of the Service. This includes, but is not limited to:

1. Treating other members with respect and courtesy
2. Engaging in constructive and relevant discussions
3. Respecting diverse opinions and experiences

6.2 Prohibited Actions: The following actions are strictly prohibited:

1. Spamming, including excessive self-promotion or irrelevant links
2. Harassment, bullying, or intimidation of any kind
3. Sharing login credentials or allowing others to access your account
4. Posting content that is offensive, discriminatory, or violates others’ rights
5. Attempting to impersonate Path to Foreign Service, LLC staff or other members

6.3 Consequences: Path to Foreign Service, LLC reserves the right to take action against any member violating these conduct rules, including but not limited to:

1. Issuing warnings
2. Temporarily suspending account access
3. Permanently terminating membership without refund
4. Removing or editing user-generated content

7. Content and Intellectual Property

7.1 Path to Foreign Service, LLC Content

1. All Content provided through the Service, including but not limited to course materials, videos, texts, graphics, and downloadable resources, is the property of Path to Foreign Service, LLC and is protected by copyright, trademark, and other intellectual property laws.
2. Your membership grants you a limited, non-exclusive, non-transferable license to access and use the Content for your personal educational purposes only.
3. You may not share, distribute, publicly display, modify, sell, rent, create derivative works from, or use Path to Foreign Service, LLC Content for any commercial or unauthorized purposes.
4. Unless explicitly stated otherwise, downloading of course materials for offline use is permitted for active members only. This permission terminates upon cancellation or expiration of your membership.

7.2 User-Generated Content

1. You retain ownership of any content you post in forums or other interactive areas of the Service (“User-Generated Content”).
2. By posting User-Generated Content, you grant Path to Foreign Service, LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User-Generated Content in connection with the Service and Path to Foreign Service, LLC’s business operations.
3. Path to Foreign Service, LLC reserves the right to monitor, edit, or remove any User-Generated Content that violates these Terms or that we deem inappropriate, without prior notice.
4. You are solely responsible for your User-Generated Content. Path to Foreign Service, LLC does not endorse any User-Generated Content and disclaims all liability in connection with User-Generated Content.

7.3 Recordings and Live Sessions

1. Path to Foreign Service, LLC may record live sessions, webinars, or other interactive events. By participating in these events, you consent to being recorded.
2. Recordings may be made available to members for a limited time as part of the Service. You may not download, copy, share, or distribute these recordings without explicit permission from Path to Foreign Service, LLC.
3. While we encourage active participation, you have the option to participate in live sessions without video or using a pseudonym to maintain your privacy.
4. You agree not to share, record, or redistribute live sessions or their recordings with any third parties.

8. Course Completion and Certification

8.1 Completion Recognition: Path to Foreign Service, LLC may offer certificates of completion or other forms of recognition for course completion. These are for personal educational purposes only and do not constitute professional certification or accreditation.

8.2 Requirements: To receive completion recognition, you must satisfy all course requirements as specified by Path to Foreign Service, LLC.

8.3 Revocation: Path to Foreign Service, LLC reserves the right to revoke any completion recognition if we determine that it was obtained dishonestly, fraudulently, or in violation of these Terms.

9. Content Updates and Availability

9.1 Updates: Path to Foreign Service, LLC strives to keep content current and may update course materials periodically. We do not guarantee any specific update schedule.

9.2 Availability: While we aim to maintain consistent access to all content, we reserve the right to remove, modify, or archive any content at our discretion.

9.3 Notifications: We will make reasonable efforts to notify members of significant content changes or removals, but are not obligated to do so.

9.4 No Guarantee: Path to Foreign Service, LLC does not guarantee the ongoing availability of any specific content. We recommend that members complete courses in a timely manner to ensure access to all materials.

10. Privacy and Data Protection

10.1 Personal Information: We collect and process your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

10.2 Use of Data: We use your personal data to provide and improve the Service, communicate with you, and as otherwise described in our Privacy Policy.

10.3 Data Security: We implement reasonable security measures to protect your personal data. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

10.4 Your Rights: Depending on your location, you may have certain rights regarding your personal data, such as the right to access, correct, or delete your data. Please refer to our Privacy Policy for more information on your rights and how to exercise them.

10.5 Third-Party Services: The Service may integrate with or link to third-party services. Your use of such services is governed by their respective privacy policies. We are not responsible for the privacy practices of these third parties.

11. Disclaimers and Limitation of Liability

11.1 Educational Purpose: The content provided through the Service is for educational and informational purposes only. It does not constitute professional advice, endorsement, or guarantee of any specific outcome.

11.2 Exam Preparation: While our courses are designed to aid in preparation for Foreign Service examinations, we do not guarantee any specific exam results or outcomes.

11.3 Individual Results: Individual results may vary based on personal effort, background, and other factors beyond our control.

11.4 Third-Party Content: The Service may include links to third-party websites or content. Path to Foreign Service, LLC is not responsible for the accuracy, legality, or content of external sources.

11.5 Government Affiliation: Path to Foreign Service, LLC is not affiliated with, endorsed by, or officially connected to any government agency or the U.S. Department of State. Our Service is an independent educational resource.

11.6 Limitation of Liability: YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL PATH TO FOREIGN SERVICE, LLC BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR ANY OTHER DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, OR DEFECT; OR ANY OTHER LOSS INCURRED IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION.

11.7 Maximum Liability: IN NO EVENT SHALL PATH TO FOREIGN SERVICE, LLC’S CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE YOU HAVE PURCHASED FROM PATH TO FOREIGN SERVICE, LLC, AND IF NO PURCHASE HAS BEEN MADE BY YOU, PATH TO FOREIGN SERVICE, LLC’S CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $50.

12. Termination

12.1 Termination by Path to Foreign Service, LLC: Path to Foreign Service, LLC reserves the right to suspend or terminate your access to FSO Compass and the Service, in whole or in part, at any time and for any reason, with or without notice, at our sole discretion. Reasons for termination may include, but are not limited to:

1. Violation of these Terms and Conditions
2. Engaging in prohibited conduct as outlined in Section 6
3. Failure to pay subscription fees
4. Abuse of the Service or its resources
5. Engaging in any activity that disrupts or interferes with the Service or its users

12.2 Termination by User: You may terminate your account at any time by following the cancellation process outlined in Section 3, or by contacting customer support.

12.3 Effect of Termination: Upon termination, your right to access and use the Service will immediately cease. Path to Foreign Service, LLC will have no obligation to maintain any data you have submitted or to forward any unread or unsent messages to you or any third party.

12.4 Survival: The following Sections will survive termination of these Terms and Conditions: 7 (Content and Intellectual Property), 10 (Privacy and Data Protection), 11 (Disclaimers and Limitation of Liability), 14 (Dispute Resolution), and 16 (Miscellaneous Provisions).

13. Indemnification

13.1 You agree to indemnify, defend, and hold harmless Path to Foreign Service, LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from:

1. Your violation of these Terms and Conditions
2. Your use or misuse of the Service
3. Your violation of any law or the rights of a third party
4. Any content you submit, post, or transmit via the Service

13.2 Path to Foreign Service, LLC reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

13.3 You agree not to settle any such matter without the prior written consent of Path to Foreign Service, LLC. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

14. Dispute Resolution

14.1 Governing Law; Exclusive Jurisdiction: Our Terms will be governed by, and construed and interpreted in accordance with, the laws of the State of Washington without giving effect to conflict of law principles. You and Path to Foreign Service, LLC agree that any disputes arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Washington, and you and Path to Foreign Service, LLC submit to the personal and exclusive jurisdiction of those courts. By using the Services, you waive any claims that may arise under the laws of other jurisdictions.

14.2 Informal Resolution: Before initiating any formal legal action, you agree to first contact Path to Foreign Service, LLC and attempt to resolve any disputes informally.

14.3 Class Action Waiver: You agree that any arbitration or other dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14.4 Exceptions: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

15. State Department Non-Disclosure Agreement

15.1 Acknowledgment of NDA: Users of FSO Compass acknowledge that they may be subject to a Non-Disclosure Agreement (NDA) with the United States Department of State (“State Department”) related to the Foreign Service application process, examinations, or other sensitive information.

15.2 Compliance with NDA: Users agree to strictly adhere to the terms of any NDA they have signed with the State Department. This includes, but is not limited to, not disclosing any confidential information about the Foreign Service application process, exam content, or other protected information.

15.3 User Responsibility: It is the user’s sole responsibility to understand and comply with the terms of their NDA with the State Department. FSO Compass does not have access to individual NDAs and cannot provide advice on their specific terms.

15.4 Content Restrictions: Users agree not to post, share, or discuss any information that would violate their NDA with the State Department on any part of the FSO Compass website or services, including but not limited to forums, comments sections, or private messages.

15.5 Reporting Violations: Users are encouraged to report any content they believe may violate State Department NDAs to FSO Compass immediately. However, FSO Compass is not responsible for monitoring or enforcing State Department NDAs.

15.6 Consequences of Violation: FSO Compass reserves the right to remove any content, suspend or terminate the account of any user who we believe has violated their NDA with the State Department, without prior notice.

15.7 Indemnification: Users agree to indemnify and hold harmless FSO Compass from any claims, losses, or damages arising from their violation of their State Department NDA through their use of FSO Compass services.

15.8 No Conflict: Nothing in these Terms of Service should be construed as encouraging or permitting the violation of any NDA with the State Department. In the event of any conflict between these Terms and a user’s NDA, the NDA shall take precedence.

16. Changes to Terms

16.1 We reserve the right to update or modify these Terms and Conditions at any time without prior notice.

16.2 Changes will take effect immediately upon posting on the Site.

16.3 Your continued use of the Service following the posting of revised Terms and Conditions means that you accept and agree to the changes.

17. Miscellaneous Provisions

17.1 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and Path to Foreign Service, LLC regarding the use of the Service, superseding any prior agreements between you and Path to Foreign Service, LLC.

17.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.

17.3 No Waiver: Path to Foreign Service, LLC’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

17.4 Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without Path to Foreign Service, LLC’s prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Path to Foreign Service, LLC may freely assign or transfer these Terms without restriction.
